1. Introduction
These Terms and Conditions (“Terms”) govern your use of all digital products, courses, wellness programs, and services (“Products”) provided by Body Mend Therapies – The Rise to Wellness.
By accessing or purchasing any of our Products, you (“Customer”, “you”, or “your”) acknowledge and agree to be bound by these Terms. If you do not agree, you must not access or use our Products. 

2. Eligibility and Capacity
By purchasing or engaging with our Products, you confirm that you are at least 18 years old and/or have the legal capacity to enter into a binding agreement.

3. Intellectual Property
All materials, including videos, PDFs, graphics, written content, logos, and branding, are the sole intellectual property of Body Mend Therapies – The Rise to Wellness.
You are granted a limited, non-transferable licence for personal use only. You must not copy, share, resell, distribute, reproduce, or modify any content without our written permission. Any unauthorised use may result in the immediate termination of access and potential legal action.

All rights are owned by Body Mend Therapies unless otherwise stated.
You may access and use our materials for your personal, non-commercial use only. Any copying, reproduction, recording, distribution, sharing, modification, resale, or commercial use of any part of our content without prior written permission from Body Mend Therapies is strictly prohibited.
Unauthorised use of our materials may result in immediate termination of access to our programs and may lead to legal action for copyright infringement.
While we take reasonable care to ensure the information provided within our programs and materials is accurate and up to date, Body Mend Therapies makes no guarantees regarding completeness or accuracy and accepts no liability for errors or omissions. 

5. Use of Likeness and AI Restrictions

9. No Practitioner – Client Relationship
Participation in our courses, digital programs, educational materials, or wellness content does not establish a therapist-client, practitioner-client, medical, or healthcare relationship between you and Body Mend Therapies – The Rise to Wellness.
All products, services, and materials are provided for educational and informational purposes only and are intended to support personal wellness learning rather than replace individual professional care. 

10. Testimonial Disclaimer
Testimonials and reviews featured on our website or social media reflect individual experiences. They do not guarantee or predict similar outcomes for others. While we strive for authenticity, we do not independently verify every testimonial. 

11. Results and Earnings Disclaimer
We may share success stories, wellness outcomes, or personal examples for illustration. These are not guarantees of results. Individual experiences will vary depending on your actions, consistency, and personal circumstances. 

12. Assumption of Risk
By participating in any of our courses, treatments, or self-care techniques, you acknowledge and accept that there are inherent risks in holistic and self-applied wellness practices.
You voluntarily assume all risks and agree that we are not liable for any injury, loss, or damage arising from your participation or application of our material. 

13. Refund Policy
All sales are final.
Due to the digital and educational nature of our Products, no refunds, exchanges, or credits will be issued once access is granted.
Where required under Australian Consumer Law, we will honour any legally mandated exceptions, such as where goods or services are faulty or not as described. See details in Refund Policy. 

14. Lifetime Access and Availability

Where a product or course is described as providing “lifetime access”, this refers to the lifetime availability of the Product while Body Mend Therapies – The Rise to Wellness continues to operate and maintain the relevant platform or service.

Lifetime access does not guarantee indefinite or uninterrupted availability. Access may be modified, discontinued, or terminated if the business ceases operation, if platforms, technology, or delivery methods change, or due to circumstances beyond our reasonable control, including illness, incapacity, force majeure, or death of the business owner.

If Body Mend Therapies changes its learning platform, website, or course delivery system, reasonable efforts will be made to provide existing customers with continued access to their purchased Product through the replacement platform, where reasonably practicable and at no additional cost.

From time to time, Body Mend Therapies may update, improve, or expand existing Products. These updates may be provided to existing customers at our discretion. However, entirely new courses, substantially redesigned programs, or separately marketed Products are not included with previous purchases unless expressly stated.

Participants are encouraged to download, save, or retain any permitted downloadable materials provided within the program for their personal use while access is available.

In the event that Body Mend Therapies – The Rise to Wellness permanently ceases operations, access to digital Products or course platforms may also cease without any ongoing obligation to maintain hosting, platform availability, or continued access.

15. Limitation of Liability
To the fullest extent permitted by law, Body Mend Therapies – The Rise to Wellness will not be liable for any indirect, incidental, or consequential damages arising from your use of our Products.
Our total liability, if any, is limited to the amount you paid for the Product in question. 

16. Indemnification
You agree to indemnify, defend, and hold harmless Body Mend Therapies – The Rise to Wellness from any claims, damages, or expenses resulting from your breach of these Terms or misuse of our Products. 

17. Termination of Access
We reserve the right to suspend or revoke your access if you violate these Terms.
You will be notified in writing and given five (5) business days to resolve the issue.
No refunds will be issued if access is terminated due to a breach. 

18. Dispute Resolution
If a dispute arises, both parties agree to attempt to resolve the matter amicably before taking legal action.
If unresolved, disputes will be handled through confidential binding arbitration in New South Wales, Australia, under applicable Australian Consumer Law. 

19. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and each party submits to the exclusive jurisdiction of the courts in that region. By purchasing or accessing our products or services from outside Australia, you expressly agree that any dispute, claim, or legal proceeding must be brought exclusively within the jurisdiction of the courts of New South Wales, Australia, and that Australian law will apply regardless of your country of residence. 

20. Modifications
We may amend or update these Terms at any time without prior notice. Updates will be effective immediately upon posting on our website. Continued use of our Products after updates signifies your acceptance of the revised Terms.

Your use of our services is also governed by our Privacy Policy.
We encourage you to review it to understand how we collect, use, and protect your information.
